Tax evasion: Arraignment of Binance, executives by FIRS suffers setback

The case against Binance and its executives was listed before Justice Emeka Nwite of a Federal High Court, Abuja on Thursday.

When the matter was called, only Gambaryan was represented by a lawyer.

The News Agency of Nigeria observed that neither the company nor Anjarwalla, who recently escaped from lawful custody, was represented by a counsel.

Gambaryan’s lawyer, Chukwuka Ikwuazo (SAN), told the court that his client had not been served with the charge, hence his arraignment cannot proceed.

The lawyer of the FIRS, Moses Ideho, though acknowledged that the agency had not served Gambaryan with the charge, he said all efforts to do so proved abortive because the defendant could not be reached at the detention of the Economic and Financial Crimes Commission.

Ideho then prayed to the court to serve Gambaryan in the open court.

The judge directed that the charge be served on him in the dock.

The lawyer, therefore, sought a stand-down of the matter or an adjournment to enable Gambaryan to consult with his lawyer.

Ikwuazo did not object to an oral application for adjournment and the matter was adjourned until April 19 for him to take his plea.

NAN on March 28 also reported that the FIRS will on April 4, 2024 arraigned Binance Holdings Limited, Gambaryan and fleeing Anjarwalla on allegations bordering on tax evasion.

In the charge, marked: FHC/ABJ/CR/115/2024, the three defendants will equally be arraigned before Justice Nwite on four counts.

The defendants are facing a four-count charge bordering on alleged tax evasion.

In the charge dated and filed March 22, 2024 by the FIRS, the defendants were alleged to have committed the offence on or about February 1, 2024.

Count one alleged that while involved in carrying and offering services to subscribers on their platform, known as Binance, the defendants failed to register with the FIRS for the purpose of paying all relevant taxes administered by the service.

The offences are said to be punishable under Sections 8 and 29 of the VAT Act of 1993 (as Amended), Section 40 of the FIRS Establishment Act, 2007 (as amended) and under the provisions of Section 94 of the Companies Income Tax Act (as amended.

FG inaugurates Port Harcourt-Aba rail line

• Promises speedy completion of 181-kilometre Aba-Enugu stretch

The Federal Government on Tuesday inaugurated commercial train operations along the Port Harcourt-Aba rail line for public use.

During the inauguration at the railway station in Port Harcourt, the Minister of Transportation, Said Alkali, launched commercial services along the 62-kilometre Port-Harcourt-Aba corridor.

Alkali highlighted that the event was part of the Federal Government’s efforts to boost trade, improve mobility, and ensure connectivity between southern and northeastern Nigeria.

According to the minister, the rehabilitation project was contracted to China Civil Engineering and Construction Company by the Federal Ministry of Transportation with an expected completion time of 36 months.

The minister stated: “It is worthy to note that the scope of the project covers the rehabilitation of the existing narrow gauge railway line, the construction of new modern stations, and the procurement of new modern rolling stock.

“This railway line will also link the ports of Onne, Bonny, and Port Harcourt to facilitate the evacuation of goods and other freight through the Eastern Corridor.

“The Federal Government, in the contractual agreement, is to provide 15 per cent of the direct construction cost, inclusive of land acquisition and value-added tax, while a bank loan through direct construction cost is to cover 85 per cent of the project.”

He said the commencement of operations of the rail line will boost economic activities between the South-South and South-East regions of the country, pending the completion of the other sections of the project.

“With the completion of the rehabilitation of the Port-Harcourt to Aba rail corridor, the Ministry will continue to vigorously drive CCECC towards the speedy completion and delivery of the 181-kilometre Aba-Enugu stretch.

“Commencement of operations on this stretch of the project aligns with priority five of President Bola Ahmed Tinubu’s Presidential Priority Areas, which identify enhanced infrastructure and transportation as enablers of growth for the economy,” he said.

FG declares May 1st public holiday to mark Workers’ Day

The Federal Government had declared Wednesday, May 1st, 2024, as a public holiday to mark this year’s Workers’ Day.

Nigeria’s Minister of Interior Olubunmi Tunji-Ojo made the declaration, according to the ministry’s Permanent Secretary Aishetu Ndayako.

“The Federal Government has declared Wednesday, 1st May 2024 as a Public Holiday to commemorate this year’s Workers’ Day Celebration,” Aishetu said in a statement on Tuesday, April 30.

“In alignment with this year’s theme, which focuses on ensuring safety and health at work in a changing climate, I wish to state that the Federal Government remains steadfast in its resolve to prioritise the safety and well-being of all citizens,” the minister said.

“Let me reaffirm Mr. President’s commitment to providing a conducive environment for work, where every worker can thrive and contribute meaningfully to national development”.

The minister, who acknowledged the contribution of workers, called for more measures to mitigate the adverse effects of climate change through synergy.

“The Minister also urged Nigerians to remain committed to the present administration’s Renewed Hope Agenda as he wishes workers a happy celebration,” the statement read

Enugu Water Corporation Deputy Director arraigned over alleged fraud

A serving Deputy Director in the Enugu State Water Cooperation, Mr. Emeka Edoh, has been arraigned before a Magistrate Court in Enugu North Magisterial District over alleged false pretence with intent to defraud some residents of Enugu the sum of N150,000.

Mr. Edoh was arraigned before Chief Magistrate Joseph Agu, Tuesday.

The charge sheet marked MEN/240/C/2024 was read out to the 56-year old defendant and level 15 civil servant, who, however, pleaded not guilty.

This was even as the Police arraigned four persons, namely Onyeka Nicholas, male, aged 27/ Okechukwu Umeh, male, aged 40; Monday Udeh, male, aged 37, and Tochukwu Eze, male, aged 28, and others at large for alleged illegal roadblock, intimidation, and extortion of money from Enugu residents and motorists.

The Water Corporation’s Deputy Director one-count charge read: “That you Edoh Emeka ‘M’ on the 23rd day of April, 2024, at No 144 Banks Avenue, in Enugu North Magisterial District, did by false pretence and with intent to defraud, obtain the total sum of one hundred and fifty (150, 000) thousand naira from Chinyere Ogbonna, Onyinye Ugwu and other members of the neighborhood with the pretence to rectify their Enugu State Water Corporation bill, which you know to be false, and thereby committed an offence punishable under section 386 of the Criminal Code, Cap 30 Vol 11, reversed Laws of Enugu State of Nigeria”

A bail application for the Defendant made by his counsel, Barr. E.E. Ezekwe, who argued that it was a bailable offence was opposed by a Senior Legal Officer from the Office of the Attorney-General of Enugu State, Barr. Onyinye Ugwu,.

Ugwu argued that the offence for which Mr. Emeka Edoh was charged was a serious one.

After hearing the arguments of both parties, Magistrate Agu granted Mr. Edoh bail in the sum of N500,000. He is also to provide a surety, who must be a Staff of the Enugu Sate Water Corporation of Grade Level 14 or above.

The matter was thereafter adjourned to 22nd of May, 2024 for hearing.

However, Onyeka Nicholas, Okechukwu Umeh, Monday Udeh, and Tochukwu Ezeh, who had been arraigned earlier were not as lucky, as Magistrate Agu refused their bail following their arraignment on three count charges bothering on felony, intent to intimidate and collect money from unsuspecting members of the public, and breach of peace.

Their charges read: “That you Onyeka Nicholas ‘m’, Okechukwu Umeh ‘m’, Monday Udeh ‘m’, Tochukwu Eze ‘m’ and others now at large on the 11th day of April 2024 at about 0010hours at Oshimiri Bus Stop, Akegbe Junction, Enugu, within the jurisdiction of this Honourable Court, did conspire among yourself to commit felony, to wit: Demanding with menace and thereby committed an offence punishable under Section 495 (a) of the Criminal Code, Cap 30, Vol. II Reversed Laws of Enugu State 2004.

“That you Onyeka Nicholas ‘m’, Okechukwu Umeh ‘m’, Monday Udeh ‘m’, Tochukwu Eze ‘m’ and others now at large on the same day, time, and place in the aforementioned Magistrate District did with intent to intimidate, demand, and collect money from unsuspecting members of the public and thereby committed an offence punishable under Section 371 of the Criminal Code, Cap 30, Vol. II Reversed Laws of Enugu State 2004.

“That you Onyeka Nicholas ‘m’, Okechukwu Umeh ‘m’, Monday Udeh ‘m’, Tochukwu Eze ‘m’ and others now at large on the same day, time, and place in the aforementioned Magistrate District did conduct yourselves in a manner likely to cause breach of peace by creating illegal roadblock and thereby committed an offence punishable under Section 247 (d) of the Criminal Code, Cap 30, Vol. II Reversed Laws of Enugu State 2004.

The matter was adjourned to 16th May 2024.

It is recalled that the Dr. Peter Mbah Administration had recently issued an order banning illegal roadblocks and revenue collection in every part of the state, warning that offenders would be made to face the full wrath of the law.It had also warned that those caught sabotaging government’s effort to ensure that Enugu people enjoy steady water supply would have the law to contend with.
